Greater Rochester Chamber of Commerce President and CEO Bob Duffy issued the following statement in response to the NYS Department of Labor’s decision to drop proposed revisions of predictive scheduling and on call/call in pay regulations:
Rochester Chamber thanks Governor Cuomo and Department of Labor Commissioner Reardon for listening to the concerns of business and dropping the proposed predictive scheduling regulations. If enacted, the policy would have adversely impacted small and medium-sized businesses which are so integral to Upstate New York’s economy. Greater Rochester Chamber of Commerce was pleased to be on the forefront of advocating for our members on this issue by presenting the real-life impact on business owners and their employees directly to the commissioner and her team. Commissioner Reardon reached out personally to share the decision, and I was glad to have the opportunity to commend her and her team on their efforts. We applaud them for their due diligence in reviewing the intricacies of the regulation.
In December 2018, the NYS DOL proposed amended regulations targeting employer “on-call” and “call-in” scheduling practices. Although the proposed rules are not yet effective, employers should become familiar with them (and how they differ from the regulations previously proposed in November 2017) and be prepared to adjust scheduling practices accordingly, or pay the additional amounts required by law.
