The rules for who is considered an independent contractor under the Fair Labor Standards Act (FLSA) have changed – again. Effective March 11, 2024, the Department of Labor (DOL) will return to its pre-Trump era guidance, and will focus on the “economic reality” of a situation to determine whether a worker is properly classified as an independent contractor or an employee.
