2021 proved to be another absolutely brutal year for employers trying to keep pace with the onslaught of changes (and starts and stops) at both the state and federal levels. The New York state and federal contractor minimum wages continue to increase, and New York’s paid family leave benefits not only increased, but also expanded their reach. Among other changes, New York also expanded its protections for whistleblowers, passed (and activated!) the HERO Act, provided job protections for recreational cannabis users, mandated transparency in electronic workplace monitoring, and increased its existing COVID-19 leave and vaccination leave requirements. At the federal level, we’ll discuss the current status of the many vaccine mandates, the latest guidance from the EEOC regarding administration of religious exemptions to mandatory vaccine policies, and other initiatives we saw pushed out during the first year of the Biden Administration.
